1. Introduction & Definitions
These Terms & Conditions ("Terms") govern your use of Clothing Consortium's services, including consigning items for sale ("Selling"), purchasing items ("Shopping"), and attending our invite-only shopping events ("Events"). By consigning an item, making a purchase, or attending an Event, you agree to be bound by these Terms.
1.1 About Us
Clothing Consortium is a curated preloved and consignment fashion business based in Cirencester, Gloucestershire. We can be contacted at clothingconsortium@gmail.com
1.2 Key Definitions
• Seller / Consignor — a person who submits item(s) to Clothing Consortium to be offered for sale on their behalf.
• Buyer: a person who purchases an item via our website or at an Event.
• Item(s): any garment, footwear, or accessory submitted by a Seller for sale.
• Sale Price: the price at which an Item is sold to a Buyer.
• Commission: the 50% share of the Sale Price retained by Clothing Consortium; the remaining 50% is paid to the Seller.
• Event: an invite-only shopping event hosted by Clothing Consortium in Cirencester or surrounding areas.
2. Consigning Items (Selling)
2.1 Eligibility & Acceptance
We accept mid-range to high-end women's clothing, shoes, and accessories in excellent condition. All Items are submitted for our review and acceptance is at our sole discretion. We reserve the right to decline any Item that does not meet our quality, brand, or condition standards.
2.2 Submission Process
Items may be submitted by drop-off / collection / online enquiry. You will be notified once your Item(s) have been reviewed and accepted or declined.
2.3 Ownership & Authenticity
By submitting an Item, you confirm that you are the rightful owner, that the Item is genuinely yours to sell, and that it is authentic and, where branded, not counterfeit. Clothing Consortium accepts no liability for Items submitted in breach of this warranty and reserves the right to remove any Item from sale, and to report suspected counterfeit goods, without liability to the Seller.
2.4 Pricing
Clothing Consortium sets the Sale Price for all Items, using our judgement of current market value, condition, and brand. The seller may dictate the price on collection, or input into pricing during the submission process (see 2.2).
2.5 Commission & Payment
Sellers receive 50% of the Sale Price as Commission. Commission is paid within 14 days of an Item selling, via bank transfer or PayPal, at the Seller's choice. Sellers must provide accurate payment details; Clothing Consortium is not liable for delays caused by incorrect details being provided.
2.6 Unsold Items
If an Item remains unsold after 90 days, the Seller will be offered a choice:
• Continue having the Item offered for sale for a further 90-day period; or
• Have the Item returned to them; or
• Have the Item donated on their behalf.
This 90-day cycle repeats until the Item sells, or the Seller chooses return or donation. If we do not hear back from the Seller within 30 days of being notified, we will either continue offering the item for sale, or if the item has been with the Clothing Consortiums for more that 180 days it will be donated.
2.7 Damage or Loss
While Items are in our care, we take reasonable steps to store and handle them with care. Clothing Consortium's liability for loss or damage will be limited to the agreed 50% Commission of the Sale Price.
3. Selling to Customers (Shop)
3.1 Payment
We accept payment via cash or card. All prices are shown in GBP (£).
3.2 Delivery & Collection
All items sold via the website can either be collected at one of our events or delivered via the post. All parcels will be sent via the Royal Mail Tracked 48 Hour service to the UK mainland. Prices will vary depending on parcel weight and will be calculated at checkout. We cannot accept any responsibility for loss in transit.
3.3 Item Condition
All Items are preloved and sold "as seen." Items are individually inspected and described as accurately as possible, but minor signs of previous wear should be expected and are not considered faults.
3.4 Authenticity
We take reasonable care to verify the authenticity of branded Items before sale. If you have any concern about the authenticity of an Item you have purchased, please contact us immediately.
3.5 Returns & Faulty Items
All sales are final. We do not offer refunds or exchanges for a change of mind. If an Item is faulty, damaged, or not as described, please contact us within 7 days of purchase or collection, with details and photographs of the issue. Where a fault is confirmed, we will offer a refund once the item has been returned to us. This does not affect your statutory rights.
4. Events (Invite-Only Shopping Events)
4.1 Invitations & Attendance
Events are invite-only and take place in Cirencester and surrounding villages and towns. Invitations may be extended to Sellers, Buyers, and members of our mailing list, at our discretion. Attendance is free.
4.2 Conduct & Capacity
We may set a maximum capacity for Events and reserve the right to refuse entry or ask a guest to leave in the case of inappropriate conduct.
4.3 Purchases at Events
Purchases made at Events are subject to the same payment and returns terms set out in Section 3, unless otherwise stated on the day.
4.4 Photography & Social Media
We may take photographs or video at Events for use on our website and social media. By attending, you consent to appearing in such content, unless you notify a member of the team on the day that you would prefer not to be photographed.
4.5 Liability at Events
Clothing Consortium accepts no liability for loss, damage, or injury at Events except where caused by our negligence.
5. General Terms
5.1 Data Protection
We collect and use contact details from Sellers, Buyers, and Event invitees in accordance with our Privacy Policy and UK GDPR.
5.2 Liability
Our liability is limited to the value of the relevant transaction.
5.3 Complaints
If you have a complaint, please contact us at clothingconsortium@gmail.com and we will aim to respond within 3 days.
5.4 Changes to These Terms
We may update these Terms from time to time. The current version will always be available on our website, and continued use of our services after changes take effect constitutes acceptance of the updated Terms.
5.5 Governing Law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
